Q: How do I commence divorce proceedings in Hong Kong?
File a divorce petition at the Family Court Registry, alone or jointly.
Q: What are the grounds for divorce in Hong Kong?
The Court shall be satisfied that the marriage has broken down irretrievably by one of the following grounds, adultery, unreasonable behaviour, one year’s separation (spouse’s consent is required), two years’ separation (spouse’s consent is not required) or one year’s desertion.
Q: Do I need a lawyer for my divorce?
You can act in person or be represented by a lawyer.
Q: How are child custody and access decided?
The welfare of the child is the first and paramount consideration for the Court. Depending on the facts of a particular case, the most common order is sole or joint custody. Reasonable access order, or if circumstances so required, defined access order to child will be made.
Q: What maintenance orders can the court make?
The usual maintenance order for spouse and children are periodical payment (secured or unsecured) order, lump sum payment order and property transfer order, based on the financial needs and the ability of the parties.
